Tariff Discretionary Log
Pursuant to the 18 CFR Section 358.5c (4).
OPERATIONAL    
Gas Quality Section 3 of the General Terms and Conditions of Transco's FERC Gas Tariff specifies the gas quality standards. Transco may refuse to accept gas tendered that fails to conform to those standards. The log identifies those active receipt locations that do not meet the gas quality standards and from which gas was not accepted.   Gas Quality
Availability of:    
  LG-S Transco may make deliveries under Rate Schedule LG-S subject to the provisions of Section 2 of the Rate Schedule. The log identifies those instances when Transco has denied requests for service or interrupted scheduled service under Rate Schedule LG-S.

The log indicates those instances under Section 19.1(d) and/or Section 19.2(d) of the General Terms & Conditions of Transco's FERC Gas Tariff when 1) Transco used its discretion to authorize or deny a waiver of the Maximum Daily Delivery Point Entitlement or 2) Transco determined that a Delivery Point or Facility Group Unauthorized Daily Overrun Quantity occurred because such deliveries impaired Transco's ability to provide firm service to other shippers on Transco's pipeline system.

  SS-1 The log provides those instances when Transco used its discretion under Rate Schedule SS-1 Section 7(c) Storage Service and Rate Schedule SS-1 Open Access to permit out-of-season injections, consistent with Section 6.2, or withdrawals, consistent with Section 7.2, injection quantities in excess of 1/180th or 1/214th of Storage Capacity Quantity consistent with Section 6.4, or withdrawals in excess of the quantity limitations consistent with Section 7.4 (i) - (iii).

  SS-2 The log provides those instances when Transco used its discretion under Rate Schedule SS-2 to permit injection quantities in excess of the Maximum Daily Injection Quantity consistent with Section 6.3, or withdrawals in excess of the Maximum Daily Withdrawal Quantity limitations consistent with Section 7.3.

  LG-A & LNG The log provides those instances when Transco used its discretion under Rate Schedule LG-A to permit withdrawal quantities in excess of firm entitlement consistent with Section 11, out-of-period injections consistent with Section 7.4 or withdrawals consistent with Section 12 and Rate Schedule LNG to permit withdrawal quantities in excess of firm entitlement consistent with Section 10, out-of-period injections consistent with Section 6.4 or withdrawals consistent with Section 11.

  S-2 The log provides those instances when Transco used its discretion under Rate Schedule S-2 to permit injection quantities in excess of the Daily Injection Quantity consistent with Section 5.3, and withdrawals in excess of the Daily Withdrawal Quantity limitations consistent with Section 6.3.   ESS Transco will schedule excess injections for Buyers under this Rate Schedule up to a total of 40 Mdt/d and excess withdrawals up to a total of 600 Mdt/d. The log provides those instances when Transco used its discretion under Section 5.2 of Rate Schedule ESS to limit scheduled injection quantities to a Buyer's Storage Injection Quantity under this Rate Schedule or has used its discretion under Section 6.2 of Rate Schedule ESS to limit scheduled withdrawal quantities to a Buyer's Storage Demand under this Rate Schedule.

PDA Deadlines Pursuant to Section 18.1 (a) (i) and 18.1 (c) (ii) of the General Terms and Conditions of Transco's FERC Gas Tariff, PDAs are due by 10:30 A.M. CCT on the day following gas flow unless Transco waives the deadline; this log identifies those instances when Transco has waived the deadline. PDA Deadlines
Payments The log identifies those Buyers for whom Transco has exercised its discretion under Section 7(a) of the General Terms and Conditions of its FERC Gas Tariff and agreed to accept payment by check rather than by wire transfer when Seller?s bill(s) for the proceeding calendar month exceeds an aggregate of $100,000. Historical Imbalances Pursuant to Section 5.8 (e) of Rate Schedule FT of Transco's FERC Gas Tariff, Transco and Buyer may agree to resolve a final reconciled historical imbalance (FRHI) on a volumetric basis, over a reasonable time period and subject to operating conditions on Transco's and Buyer's systems. A historical imbalance is defined as an imbalance created prior to July 1, 1991. Transco has the right to adjust the agreed upon timing of the volumetric make-up of a FRHI to maintain the operational integrity of Transco's pipeline system. When Transco exercises that right, those instances will be noted in the attached log.
Payments
Hurricane Katrina Pursuant to the Commission's order issued October 12, 2005 in Docket No. RP05-666-000, Transco may waive on a nondiscriminatory basis penalties, fees or other charges incurred as a result of Hurricane Katrina. Discretionary Waivers This log provides those instances when Transco exercised its discretion under Section 31 of the General Terms and Conditions of Transco?s FERC Gas Tariff to waive its rights or any obligations of a shipper as to any specific default that has already occurred or in advance as to any specific temporary problem. s Nomination Cycle Deadlines The “Nomination Cycle Deadlines” log identifies those instances when Transco waived standard nomination cycle deadlines and did not otherwise post a notice of that extension.  Section 28.1(a) of the General Terms and Conditions of Transco’s FERC Gas Tariff allows Transco to waive, on a nondiscriminatory basis, the standard nomination cycle deadlines for nominations, quick response, confirmations and scheduled quantities.  Pursuant to this Section 28.1(a), Transco accepts all electronic nominations whether submitted via online, upload or electronic data interchange up to the stated deadline in Sections 28.1(b) and (c) for receipt of nominations through electronic data interchange.   Payments
